PURCHASE AGREEMENT
(drafted pursuant to Legislative Decree no. 21 of February 21, 2014)

Premise This contract is concluded between: Italian Luxury Taste srl with the head office in V. le dell’Industria no. 330 Corridonia, Macerata postal code 62014, VAT number: 01984780435 Registration Number MC – 198079 (below also ILT) – and the final consumer (in the following: “Customer”) and can be configured as distance sales contract. It is regulated by Legislative Decree no.21 of February 21, 2014, in implementation of 2011/83/UE on consumer rights and has as its object the purchase and sale of movable goods (wine, food and fashion products).
By this contract ILT transfers or undertakes to transfer the ownership of the said goods to the Customer and the Customer pays or undertakes to pay the price. The purchase of the goods may be made through the following ways:

2) E-mail: info@italianluxurytaste.com.

- THE MINIMUM AMOUNT OF EACH ORDER MUST NOT BE LESS THAN € 150.00.
- UNLESS OTHERWISE AGREED BETWEEN ILT AND THE CUSTOMER, ALL ORDERS SHALL BE PAID FOR IN ADVANCE ACCORDING TO THE FOLLOWING TERMS AND CONDITIONS.
The goods that can be purchased are presented on the said website (catalogue). Please note that ILT intends to serve exclusively the final consumer, for whom all products on sale are intended. Persons with a VAT number who intend to receive an invoice must make a request, indicating the references, at the time of ordering. Starting from the 1st of January 2019, following the introduction of the obligation of electronic invoicing, it will not be possible to issue an invoice if it is not requested at the time of ordering.

How to purchase – sales contract

1) Website www.italianluxurytasteshop.com The Customer must fill in the order by clicking on the product(s) chosen, included in the catalogue, and adding them to your shopping cart. The content of the orders, in this way, can be filled in by the Customer at his discretion. It is possible to correct errors by accessing the cart, before the final step that concludes the order. After selecting the products, the Customer will display the contents of the cart and the relative amount to be paid, with the possibility of updating and/or modifying it.

2) Then, the Customer will continue with the completion of the order (by filling in the "client type" field depending on whether he is a Private or Company for billing information) following the instructions for filling in the path established by the Site and up to the "checkout" function. Payment and delivery, lastly, will take place according to the sequential indications already established in the path of the Site and confirmed by the automatic sending of an email to take charge of the order. Once the phase has been completed, the sales contract is deemed to have been finalised.
The Customer may receive the order within 8 working days after effecting payment according to the terms described above.

3) Adhering to the General Conditions, by filling in the order, the Customer declares to be at least 18 years old and to have the capacity to act.

Description of products, characteristics and prices

The characteristics and the description of the products on sale are indicated on the on-line catalogues on the ILT website in the correspondence with the individual product.
The prices of the goods are on the specific section, including VAT and any other eventual taxes. The period of the promotions and offers is indicated in correspondence with the product or offer to which it refers, as well as the prices applied. Any additional expenses, where applicable, are indicated in correspondence with the product to which they are applied.

Shipping costs

For each order delivered on Italian territory to the same recipient, regardless of the number of products delivered in a single solution, shipping is free. For orders through the Website, to be delivered abroad, the amount of the shipment will be agreed with the Customer after issuing a suitable estimate.
For orders over € 2,500.00, a packaging fee may be required, the amount of which varies depending on the product to be delivered and, in any case, is transparently indicated in the documentation - paper or electronic - that allows you to complete your order (See "Request a quote").

Accepted payment methods

The following are accepted: (i) Bank Transfer, (ii) PayPal, (iii) Credit Card CartaSì, MasterCard, American Express, Visa. It should be noted that ILT shall not impose on the Customers, in relation to the above-mentioned payment cards, any charges for the use of the same, or in the cases expressly established, any charges exceeding those incurred by ILT itself.

Delivery terms and liability

ILT, in compliance with art. 61, legislative decree 21/2014, undertakes to deliver the goods within 10 working days from the date of the order. Delivery shall be deemed to have been made when the goods ordered are in the possession of the Customer or of the person delegated by the Customer to collect them. In the event that these terms cannot be met (e.g.: products not in stock), ILT undertakes to notify the Customer by the most appropriate and timely means, in order to communicate the new delivery schedule for the goods. Although art. 63, legislative decree 21/2014 establishes that if the products are lost or damaged, for reasons not attributable to ILT, the resulting risk is transferred to the Customer only at the time when the latter, or a third party designated by him and different from the carrier, materially takes possession of the goods, ILT undertakes to replace the damaged products without any charge to the Customer, who must notify the following email: info@italianluxurytaste.com

Unrequested supplies

Unless the Customer's consent, to be expressed before or at the time of conclusion of the contract, ILT shall not carry out any supply other than that agreed, even if of equivalent or superior value and quality. Should the Customer receive an unrequested supply, he/she shall notify ILT thereof by means of the following e-mail: info@italianluxurytaste.com.

Right of withdrawal

The art. 52, Legislative Decree 21/2014 allows the Customer to exercise the right of withdrawal (i.e. the right to return the goods, for whatever reason and without any charge to him/her) 14 (fourteen) days after delivery of the goods. Therefore, the Customer may exercise the right of withdrawal within 14 (fourteen) days from the goods ordered, without any charge to him/her, by simply notifying ILT.

The right of withdrawal can be exercised by submitting any explicit declaration of the decision to withdraw from the contract, by e-mail (info@italianluxurytaste.com.);

Upon receipt of the withdrawal request, ILT shall collect the goods from the Customer, without charging anything to the Customer. In order to report any anomalies or misunderstandings or inefficiencies or receive assistance on products that do not comply with the order, the Customer may contact ILT at the above mentioned email addresses.

In case of withdrawal, the obligations of ILT and the Customer shall lapse. In particular, ILT shall reimburse the Customer for the costs of the products ordered, including delivery costs, within 14 (fourteen) days from the moment in which the Customer has been informed that he wishes to exercise the right of withdrawal. ILT shall reimburse the Customer with the same instrument used by the Customer to pay for the order, unless otherwise agreed between the parties.

Legal warranty

The warranty does not cover damage due to wear and tear, improper use or incorrect maintenance. The legal guarantee of conformity protects the Customer in case of purchase of defective products, which function badly or do not correspond to the use declared by ILT or the manufacturer of the good or for which that good is generally intended. The Customer may assert its rights regarding the legal guarantee of conformity by contacting the manufacturer of the goods directly, even if different from ILT. In the presence of a conformity defect, the Customer shall be entitled, at his choice, to repair or replace the defective goods, without charge, unless the remedy requested is impossible or excessively expensive compared to the other. If replacement or repair is not possible, the Customer shall in any case be entitled to a reduction of the price or to a sum, commensurate with the value of the goods, in return for the return of the defective product to ILT. The legal warranty shall last for 2 (two) years from the delivery of the goods, and shall be asserted by the Customer within 2 (two) months from the discovery of the defect.

Competent Forum

For any civil dispute between ILT and the Customer, depending on the legal interpretation and conditions presented herein, the mandatory territorial jurisdiction shall lie with the Judge of the Customer's place of residence or domicile, if located in the territory of the State.
